So I got pulled over last night......

After work last night, taking advantage of my mother in law(free babysitter) visiting us, my wife and I decided to have dinner by ourselves. Nothing big just went for some burgers and drinks at Red Robbin. Had one beer with my dinner.

While driving home I drove past a state patrol officer who quickly hit a U-turn and ended right behind me. I wasn't nervous because I knew I didn't do anything wrong, but had a strong feeling I was gonna get pulled over. So surely enough the stater hit the lights and we pull over.

Having my CCW licensed I was of coursed armed. Now I read conflicting arguments as to tell the officer right away you have a firearm, versus to wait till they ask if you have any weapons. And Yes i saw the video that was posted here. So I decided to wait till the officer asks. They officer pulled me over for not having a front license plate. And while speaking the officer smelled the alcohol on my breath. She asked where we were coming from and if I had any drinks with my dinner, which I said yes I had 1 beer with my dinner.

The officer ask if I'd voluntarily take a few tests, so I said sure. We just did the eye test and I pass with flying colors. The officer says I believe your fine, but would I voluntary take a breathalyzer just to see what I blow. She even said even if I blow above a .08 that she wouldn't arrest me, just have someone else drive us home. Which I thought was a bit odd. I said if I don't have to, I don't want to. The officer thanked me for being so cooperative and wished us a goodnight. All this while having my firearm in my chest pocket of my jacket.

So was I in the wrong for not notifying the officer that I was armed? She never did ask me.

I don't think you were in the wrong at all....
I think you treated her with respect, and she treated you the same.

Handing her your CCW may have changed her demeanor? That said.. if you had passed it to her, she may have handled the situation the same way after securing the weapon?

Not wrong at all. State law says you don't have to declare, that means you don't have to declare.

Personally, I think it's better to tell them than to have them find out without telling. Having them find it, IMO, could lead to some uncomfortable situations. I know if I was a cop, pulled someone over and found a weapon on them I'd be nervous as ****. Rather have them be up front about it.

I would reccomend that if your ask to step from the car and you do so, let them know you have a gun. Normally an officer / deputy will pat you down prior to field sobriety tests....not sure why this troop did not.....but it's better to let them know up front before they find it. just saying.

I think you handled it fine; I think it boils down to what the law states and what your comfortable with. I have my DL, Permit and Veteran's ID card in the same slot of my wallet, so would hand all ID's to the officer and wait for instructions. (keeping hands on the wheel in clear view) Another thing veterans might consider is both my car and truck have WA Veterans plates. One of which is a permanent plate. Kinda identifies you if your ever pulled over...AJ

i agree with RK - if you are following the law, what can "they" do to you??? so what is next - punishment for ABIDING by the law...??? awkward situations aside -- you follow the law and should not be punished, and were not. write it down( which you kinda did postin it here) cause next time you might get stopped by some rookie lookin to prove somthin.. i say bravo zulu to ya man, cause i would have been sweatin buckets..

Well... they could shoot you?

lol

Esp if your in LA driving a blue pickup?

If you get pulled for suspicion of DUI, don't disclose firearm, and a (unreasonable) officer gets the wrong impression, you could be in a very not fun place VERY quickly.

...could have handed him a Neg 1. That would have been ugly. Don't be a dick just becuase you can, be courteous and 99% of the time that will come back to you.
