While I support OC as much if not moreso than most, if the reports of how this guy was acting are true then he deserves to be arrested.

It did seems obvious that he was actually trying to achieve this, doesn't it? To attract attention by making absolutely certain the he was openly carrying in a very high traffic area. This doesn't really help the cause all that much, it makes him appear to be something of a wingnut.

EDIT: and if you are just doing something like this to make a statement for a cause, why the hell would you have one in the chamber and two extra mags? :hmmmm2:

Well if he really was hanging outside an Albertsons for 10-15 mins... with an openly displayed side-arm wouldn't you think it was a little strange... go in do your shopping and leave... sounds a lil fishy to me

Please, standing outside Albertsons does not "warrant cause for alarm". From the sounds of the articles I've read on this case, he was waiting for his wife (who was inside). In WA an visible holstered side arm is not against the law. Without additional evidence to show he "warranted alarm" or was "intimidating", I do not see how he has broken any law.

Never said he broke the law... just saying that people would think it was odd to just stand in front of a store with a displayed firearm... When my girl is in the store I wait in the car... Look at it from both sides don't be bias because your a gun owner.

Back when I was dating a chick who had did not like me smoking, it was pretty common for me to stand outside and have a cigarette while she went in and got what she needed. I don't think standing out front gun or not is odd. I believe there needs to be more to arrouse suspision, and from the articles I don't see anything to that point. I'm not bias because I'm a gun owner, I'm bias because I believe in the law and from the information put out I see no violation.

From the reports I've seen he was staring people down and acting like he was going to draw his gun on them.

I OC with one in the chamber, 2 reloads, and a couple mags in the car, but from what I've read this guy was pushing it. If all he did was stand out front and people exagerated stuff then he should be able to afford a nicer gun than his XD when the lawsuit is over, but if he is doing as the reports I've seen suggest then he should and will lose his gun rights because he obviously is not mature enough to be making a life and death decission.

hey maybe the open carry people will come to his rescue, :hmmmm2: I don't think so. hey maybe some liberal was scared(Greg), If he acted agressive and like he was going to draw on me I would have dropped him

ummm how many can a XP carry in its Mag in .45? this # seems pretty high.

Here is my take on the whole thing. He wanted to press the point that WA is a OC state by hanging out at high traffic areas. I think he wanted to get busted. I am glad to see someone stirring the pot of what is allowed vs what is the law. Way to long we have had to deal with what some people think should be right, not based on any facts or laws. I am lucky to live in a ranch town where rifles are still hangin in the back windows of pickups, but I also get to hear how bad people with guns are from the college professors "If I had my way..." and "Its not right for people to be able to..." These people need a reality check and this court case will be just that, if it goes to court.

Those who cant or wont do, are often protected by those who get busted for it. go figure.

I don't know how many a Springfield "XP" mag will hold, but my XD .45 has 13 rd mags. (13x3) + 1=40 by my count. If he had an XD compact in .45 with a 10 round + one in the chamber and two 13 round extended mags, that still adds up to 37, but poor journalism editing is not the point here.

I don't think anybody here is going to argue against open carry or pointing out to the general public that OC is not illegal. What is a salient point in this story is the perceived way in which this guy conducted himself.

It would certainly seem there is more to it than a guy carrying a gun in public.
The following line from the story makes me wonder if it were carried partially covered by his shirt. If that were the case then he could have had a partially concealed partially exposed weapon which would be a problem.

Three officers approached the supermarket and saw Kirby outside, wearing a skin-tight T-shirt that didn’t cover the large holstered gun.

It seems like he meant to press the issue and may have technically been carrying the weapon in an incorrect manner. But of course I wasn't there and neither was anyone else from this forum.

It reminds me of the recent incident where the Black Panthers were standing out in front of the polling place with clubs in their hands, except of course they were not arrested

It will be interesting to see how this plays out.
