guns and pot?

I hope this is the right forum to ask. I recently talked to somebody who said that it's a felony to possess marijuana and a firearm at the same time. Like say you legally had a firearm (no prior felonies or anything) and you had a little stash of pot at your house. If the cops found you had both in your house it's a felony and they would take your gun away and throw you in jail. I don't think that is true. I've checked Washington laws and googled it and couldn't find anything. Without this turning into an argument about marijuana use, does anybody know the law in this context? I'm sure that if there was an intent to sell charge it would be a different story, so I'm just talking about simple possession which is not a felony. This guy was from the south so I think the laws there are more strict.

OK; let's think this out. you know that form you fill out when you perchase a firearm? well one of the questions is ( are you using any illegal drugs?) and you had to say no or you don't qualify to own a firearm. SOOOOOO it would depend on the officer but, I think the answer is a big yes it is a felony.

I'm pretty sure it's a felony. I don't have the text to back that up but I wouldn't even chance it.

Michigan Drug and Gun Offenses | Aggressive Criminal Defense Law Firm Serving Wayne, Oakland, Macomb, Washtenaw, Ingham, and Livingston counties.

Drug offenses are made more severe by the presence of guns and violence. Where guns and violence are involved, the police are more likely to suspect a "drug ring" and investigate more aggressively. The prosecution is also likely to charge more aggressively. The gun charges alone could greatly increase the length of your sentence. But if you are involved in a drug and gun offense, you could also be facing charges for trafficking, export and import crimes, money laundering, RICO and conspiracy. Such charges could also change your state drug case into a federal drug case.

Just think they will not only take your gun, but prohibit you from ever legally owning one since you are now a fellon.

I wouldn't want to trade my 2nd Amendment right to bear arms for the "right to remain silent". Seems like a lousy trade to me.

Since when is possession of marijuana a felony?

Possession of one ounce or more of marijuana is a Class B felony, punishable by a maximum 10-year prison sentence and a $250,000 fine. If you are convicted of possessing more than an ounce of marijuana, and you have not been convicted of a drug offense before, you may ask for a “conditional discharge.” This means the judge will place you on probation for up to five years with the understanding that if you obey all the terms and conditions of your probation, the charges will be dismissed at the end of the probationary period. If the charges are dismissed, you may truthfully say that you were never convicted of that charge.

Oh right, I forgot how ******* stupid our federal government is, and treats marijuana as a Schedule 1 drug, right up there with heroin and LSD, as having "no recognized medical use" despite it having more medical uses than any single substance known to man. :tard:

At least some states like WA are slowly pulling their heads out of the asses.

I quit smoking pot about the time I joined the Navy. Look at it this way. The more you spend on pot the less you have for guns, ammo, etc...

It's time herb was legalized. Period.

yea and then the government can regulate it, tax the **** out of it and make all the haters feel good about it.

pot is one of the most socially acceptable drugs out there,
Not only is it used for medical patients, chronic pain sufferers, but also as a social drug.
Hell i bet if you were to test our government employees you would find that over 50% of then use pot as a social drug.

The only down side to pot being legalized if that i would have a harder time finding chips and Twinkies.

I do not smoke but do have several people i know that do, I do think that it should be legalized though.
Hell if it is, the violent crimes rate might just drop to some of the lowest levels since like forever.

Does pot and guns mix? I don't think so. should they ever be together? again i don't think so.

but with pot being one of few drugs, that is not normally related to violent crimes who am i to say that they (guns & pot) cant go together.

any how im rambling and the pain meds are making me loopy :banghead:

Take it easy out there guys, stay safe and have an awesome day.

I don't think pot and firearms mix any better than alcohol and firearms. Both are bad ideas.

With that said.. how many of you have seen/heard of shooters going out plinking and drinking beer at the same time? I hear it all the time. Just plain stupid.

But... do you go to jail if Johnny Law finds a couple fifths of Jack Daniels in your house full of guns? Nope. Herb shouldn't be any different.

I agree with this statement, though to get the actual legal answer just contact the Attorney General. Office of Attorney General Rob McKenna
