Clarification of ATV and Carrying a Gun

Saw this on another site. They clarified some language.

SECTION 6. ORS 821.240 is amended to read:
821.240. (1) A person commits the offense of operating a snowmobile or an all-terrain vehicle
while carrying a firearm or bow if the person operates any snowmobile or all-terrain vehicle with
a firearm in the possession of the person, unless the firearm is unloaded, or with a bow, unless all
arrows are in a quiver.
(2) Subsection (1) of this section does not apply to a person who is licensed under ORS
166.291 and 166.292 to carry a concealed handgun.

(3) As used in this section, “unloaded” means:
(a) If the firearm is a revolver, that there is no live cartridge in the chamber that is
aligned with the hammer of the revolver;

(b) If the firearm is a muzzle-loading firearm, that the firearm is not capped or primed;
or
(c) If the firearm is other than a revolver or a muzzle-loading firearm, that there is no
live cartridge in the chamber.

[(2)] (4) The offense described in this section, operating a snowmobile or an all-terrain vehicle
while carrying a firearm or bow, is a Class B traffic violatio

I know in Washington it's a big no no to have your rifle loaded while on your atv at anytime (curious if you are on private property if it still applies), F&G usually hang out in certin spots here just to catch folks breaking the law.

WA residents BEWARE! Washington Department of Fish and Wildlife is trying to "Clarify" the rules for firearm carry in/on vehicles. In doing so, their proposed rules could just possibly prevent anyone from legally carrying a loaded handgun with or without a CPL. Because of the vague wording they may "flubber up" things for legal carriers. They keep using the term "Firearm", rather than "Rifle or Shotgun". Last I heard, pistols are also firearms.

I knew what you had posted was for Or. just filling in Wa. peeps. From what F&G officers that I know personally said was if it's hunting season(modern firearm) and you have your rifle or shotgun loaded while operating your atv you will be ticketed(sp) as for a side arm with a cpl you will be okay. No different than having a long gun loaded in the vehical while driving, big no no, don't think the cpl covers rifles or shotguns right?

WA F&G is proposing some changes in the Law that may change this. If ALL Firearms are banned from vehicles as their proposed wording indicates there could well be no exception for CPL's and pistols carried for SD. It's not current law that't the problem in WA, it's what it could become if F&G is successful in the change.

Just remember, it was F&G that lead the fight to ban ALL lead ammo in WA State. Wouldn't trust them to not try an activist approach to getting ALL firearms out of vehicles, not just rifles and shotguns.

Even if they tried to do that, there's no way anything would stick. RCW 9.41.050 specifically spells out when/where you can carry a pistol loaded/unloaded in a vehicle. Just another case of Olympia being too smart for their own britches.

Whoops my bad, didn't read the whole thread. If they get that passed, I will sh*t bricks. That's even more restrictive than California. Let us know if any bills are introduced, I will be on the horn to Olympia within the hour.
