Texas Soldier Arrested for ‘Rudely Displaying’ Weapon

Texas Soldier Arrested for

I'd have been more cordial for sure, knowing that open-carrying an AR is just asking for trouble. But the response is bullshit. I'm curious to know what they charged him with.

There was another story on FB a month or two ago about a guy in Bellevue who, while taking off his jacket to get into his car, flashed his concealed pistol to passersby. Bellevue PD showed up minutes later and had him cuffed before they even asked him if he had a CPL.

A few weeks ago, I was driving home from work and saw a couple guys carrying stuff from a pickup into their house a couple blocks from my house. I happened to notice one of them had a pistol on his hip, and he was not a cop. I didn't think much of it and continued to drive home, without calling 911 or anything. True story.

I like stories with a happy ending.

Wow! I didn't know we could be arrested, stripped of our weapons & jailed for doing something in a "rude" fashion. If that's the case, you guys are all doomed...

If I see something like that I'm more inclined to strike up a conversation than anything else...

Yeah, the minute your concealed becomes not concealed, and it gets reported to the authorities, it's a problem. It's a fast track to having your CPL revoked.

If it's not concealed, isn't it open carry?

And, isn't open carry legal?

Why would your CPL get revoked?

Yeah, it doesn't really work that way...

I don't know about the CPL being revoked, but it could be suspended if/while the person is charged and it's being cleared up.

Dunno, I'm not LEO.

But if you're licensed and concealing -- great. If you then stop concealing (exposure) and then go back to concealing, you've pretty much violated what you're licensed for.

I'd think most cops would simply question you, find out you're legit with your CPL and then let you on your way -- probably talking to you about keeping your gun concealed. I don't know of any crime on the books though.

Maybe Boz will chime in.

But for instance, today I received a notice from my son's school. There was some police activity near the campus due to shots fired. It was resolved without incident, but let's say it wasn't. Let's say the person responsible wasn't located. Then a person sees me getting into my car, but when I take my jacket off they see a gun. They call 911, the cops arrive, I'm detained, gun confiscated and become a person of interest. Until it gets cleared up, I could imagine my CPL would be suspended...

Kinda of surprising, since he is a SOLDIER and he is a TEXAN.
Two types of people I would be more prone to bullshit with rather than call law enforcement on.
Open carry is legal, and the police will know this. A law is a law, and should not be up to personal opinion!
Not hard to understand!

Exposing a concealed weapon can fall under RCW 9.41.270 "warranting alarm". Like Richard said you can't go from concealed to open at your whim, or call it open carry because your jacket opened up or you dropped it out of your holster in the check out line. If the police have to keep having conversations with you about this, your CPL is in jeopardy according to the CPL training I got.

So a little clarificaiton. In Texas you can not open carry pistols, but you can OC long guns (maybe only if you have a CHL, I'm not sure, but either way he was ok).

And in WA, flashing your concealed pistol is not illegal unless you do it intentionally and had no just cause.

The only restriction to open carry here in Washington is when driving a vehicle without CPL. Otherwise open carry should not be a fast track to anything except mind your own damn business, IMO.

Then again it was Bellevue which is a different kind of place in itself.

And that stuff about warranting alarm is irrelevant. That applies to brandishing or threatening behavior with your hand on the grips. There is no requirement here to keep a concealed pistol concealed.

The key to this staute is "at a time and place that either manifests an intent to intimidate another or that warrants alarm for the safety of other persons."

Not getting into a car, for cryin' out loud, if that's all it was. Not sure what this term "flashing" was supposed to entail.
