I'm a WA resident, and I wish to purchase (via private party) a handgun from an OR resident. He says that by law, he can not sell it to an out of state resident, and that if I want it he will have to send it to an FFL. If I can, I'd like to avoid that hassle, transfer fees, shipping, etc. Is there no other option? Does this law only apply to out of state residents purchasing from a gun store and not apply to private party sales? Thanks in advance! |

The seller is correct. Out of state gun transfers without the use of an ffl transfer are a felony. It sucks but if you just have to have the gun then you'll have to have him ship it to an ffl.

Thanks for the info! What if a person was once an OR resident, legally purchased a handgun there, and then moved to WA? Can he sell it to WA residents without the use of an FFL? Would he then need to use an FFL to sell it to an OR resident since he is no longer an OR resident? Just a little confused here, thanks for your patience |

I don't know all of Washington's gun laws unfortunately. I know that in Oregon face to face private gun transactions are legal as long as both the buyer and seller are in state residents. If your drivers license says you are a Washington state resident then you would need to ship to an ffl for an out of state transaction. I hope that helps.

Okay, another question! Would I be able to purchase a handgun from an Oregon FFL? Or would he still be required to ship to an FFL of my state of residence? |

You would still have to have the gun shipped to a Washington ffl for them to do your BGC and such.

I believe this only applies to handgun purchases. It is my understanding that you can purchase long guns from both private parties & out of state FFL's & legally bring them home to Washington.

I don't think it matters if it's long gun or hand gun but I don't know the laws for sure for Washington. Definitely good to talk to someone official about it.

Not sure on washington laws, but like others said a handgun across state lines must be transfered through an ffl. If you now reside in washington and have a washington Drivers License then you must follow your state laws on in state transfers. As for long guns I can sell a long gun to a resident in a connecting state if it does not violate either state law. As an example someone from Idaho wants to buy a shotgun from me, an ffl dealer in Oregon, I can sell it to him. This one is a little trickier as you have to know the laws of both states as well as federal law. |
